1. About these terms

These Terms & Conditions form a binding agreement between you and INSTASWICH LIMITED (CAC RC 9737253), operating the brand InstaSwich jointly with Novel Charts LTD and Trade Novela Limited. By accessing instaswich.com, purchasing a subscription or course, submitting an enquiry, or using any InstaSwich service, you accept these terms. If you do not accept them, do not use the services.

2. Eligibility

• You must be at least 18 years old and legally capable of entering into contracts.
• You must not be resident in, or acting on behalf of a person in, a sanctioned jurisdiction.
• You are responsible for confirming that using our services is lawful where you live.

3. What we provide

InstaSwich provides:

• Market research and algorithmic trade intelligence, delivered primarily through Telegram and TradingView.
• Structured trading education and mentorship programmes.
• Business development, Introducing Broker and Master IB consulting for firms and individuals.
• Deposit and withdrawal assistance for eligible clients of participating broker partners.

We are not a broker, exchange, custodian, portfolio manager or licensed investment adviser. We do not execute trades for you and we never take custody of trading capital.

4. No investment advice

All content, signals, analysis, statistics, education material and commentary are provided for informational and educational purposes only. Nothing constitutes personalised investment, tax or legal advice, or a solicitation to buy or sell any instrument. You alone decide whether and how to act, and you bear the full result of those decisions. Read the full Risk Disclosure before subscribing.

5. Subscriptions and billing

• Plans are billed in advance for the stated period, in USD unless another currency is offered at checkout.
• Access begins once payment is confirmed and your delivery channels have been activated by our support desk.
• Recurring plans renew automatically for the same period unless cancelled before the renewal date.
• You may cancel at any time; cancellation stops future renewals and access continues until the paid period ends.
• We may change prices for future periods with reasonable notice; the price of a period already paid does not change.
• Taxes, bank charges, card fees and currency conversion costs imposed by your provider are your responsibility.

Refunds are governed by our Refund Policy. Payments are processed by third-party providers; failed, reversed or disputed payments may result in immediate suspension of access.

6. Education programmes

Course fees are one-off unless stated otherwise and cover the syllabus, materials and mentoring window described at the point of sale. Materials are licensed to you personally and may not be recorded, resold or redistributed. Session schedules may be adjusted; where a session is cancelled by us it is rescheduled at no extra cost. We make no guarantee of profitability, employment, funding-challenge success or any specific outcome.

7. Business development and Introducing Broker services

Consulting engagements, IB and Master IB arrangements are governed by a separate written agreement setting out scope, fees, commission structure and term. Where we introduce you to a broker or partner, you contract directly with that firm under its own terms and regulatory protections. We may receive introducing commissions from partners; this never increases what you pay.

8. Deposit and withdrawal assistance

Where offered, funding assistance is an operational convenience for eligible clients of participating brokers. Displayed rates are indicative and valid only for the confirmation window stated at the time of quotation, and applicable margins and processing fees are shown before you confirm. We are not a bureau de change or money transmitter and we do not hold client funds on deposit.

9. Compliance obligations

We may request identification and source-of-funds information under our KYC Policy and AML Policy. We may delay, refuse, suspend or terminate a service where verification is incomplete, information appears false, or a transaction presents financial-crime risk.

10. Acceptable use

• Do not resell, sublicense, redistribute, mirror or publish our signals, analysis or course materials.
• Do not share account credentials, invite links or channel access with any other person.
• Do not scrape, reverse engineer, probe or disrupt our infrastructure, or attempt to bypass access controls.
• Do not upload malware, unlawful content or another person's data without their permission.
• Do not impersonate InstaSwich, our staff or our partners, or misuse our name in promotions.

Breach may result in immediate termination without refund and, where appropriate, legal action.

11. Intellectual property

All trademarks, logos, software, models, written content, charts and course materials on this website are owned by or licensed to InstaSwich and its joint operators. You receive a limited, personal, non-exclusive, non-transferable licence to use them for your own trading and learning for as long as your subscription or enrolment is active. All other rights are reserved.

12. Third-party platforms

Delivery depends on third parties such as Telegram, TradingView, WhatsApp, email and payment providers. Their availability, terms and pricing are outside our control, and we are not responsible for their outages, data errors or account actions.

13. Availability and changes to the service

We aim for continuous availability but do not guarantee uninterrupted or error-free service. Maintenance, upgrades, feature changes and channel migrations may occur. Where a change materially reduces the value of a paid plan, we will offer a pro-rated credit or an equivalent alternative.

14. Disclaimers

To the maximum extent permitted by law, the services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of data, or non-infringement. Published performance figures, back-tests and equity curves are historical and are not a promise of future results.

15. Limitation of liability

Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded. Subject to that, InstaSwich, Novel Charts LTD and Trade Novela Limited are not liable for trading losses, lost profits, lost opportunity, missed or delayed signals, data inaccuracies, or indirect or consequential loss. Our aggregate liability for any claim is limited to the fees you paid to us in the 3 months before the event giving rise to the claim.

16. Indemnity

You agree to indemnify InstaSwich against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the services, or your infringement of a third party's rights.

17. Suspension and termination

We may suspend or terminate access immediately for non-payment, chargeback abuse, breach of acceptable use, a compliance concern, or where required by law. You may stop using the services at any time. Clauses that by their nature should survive termination — including intellectual property, liability, indemnity and governing law — continue to apply.

18. Complaints and dispute resolution

Please raise complaints first with support@instaswich.com. We acknowledge complaints within 3 working days and aim to resolve them within 15 working days. If a dispute remains unresolved after 30 days, the parties will attempt good-faith negotiation before commencing formal proceedings.

19. Governing law and jurisdiction

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos State have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you in your country of residence.

20. General

• If a provision is found unenforceable, the remainder continues in force.
• Failure to enforce a right is not a waiver of it.
• You may not assign your rights without our consent; we may assign ours as part of a business transfer.
• These terms, together with the policies linked here, form the entire agreement between us.
